Welcome to Boat me up, we appreciate your preference.
The services available on and through this website are provided by Boat me up, Lda (“Boat me up”).
The use of Boat me up, is governed by these Terms and Conditions and by using Boat me up, you agree to be bound by this Agreement.
Boat me up, reserves the right to modify this Agreement at any given moment and such modification shall be effective once posted on Boat me up Site. You should review this Agreement regularly.
Reservation and Cancellation policy
Reservations will only be confirmed on receipt of full payment.
Cancellation
Boat me up reserves the right to cancel any tour due to bad weather conditions, on the day of the tour itself, as weather and tides can change unexpectedly.
In the event that Boat me up cancels the tour, you may choose between a rescheduling of the tour or a full refund.
Where the Customer cancels a reservation, refunds will be given under the following conditions:
- If notice of cancellation is given more than 15 days before departure: 50% refund.
- If notice of cancellation is given less than 15 days before departure: No refund.
Code of conduct for Passengers
If passengers do not act according to the instructions provided by the Skippers during the Tour, Boat me up reserves the right to terminate the tour immediately.
Moreover, Boat me up cannot be held accountable for passengers behavior that result in personal or third part injury.
In addition, it is Passengers’ liability to inform the Skippers, prior to the Tour departure, if they don´t know how to swim. In this case, Passengers must wear the life-jacket during the entire Tour.
Copyright and content ownership
The Site and the Services, as well as certain content available therein (together, “Boat me up Intellectual Property”), are protected by copyright, trademark and other intellectual property laws in the United States and other countries. Boat me up owns and retains all such rights in the Boat me up Intellectual Property. You may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Boat me up Intellectual Property appearing on the Site or through the Services.
Without limiting the foregoing, Boat me up and the Boat me up logo are trademarks of Boat me up, protected under Portuguese law. Other parties’ trademarks used, depicted or identified on this Site are the property of their respective owners, used here by permission, and may be registered in one or more countries. Use on this Site of the trademark(s) (including, but not limited to, names and logos) of any other party is not intended to imply Boat me up’s affiliation with or endorsement of that party, or that party’s sponsorship or endorsement of Boat me up and their products or services.
User Conduct
As a Boat me up user you must comply with some conduct rules and agree on not using Boat me up to:
- Conduct or participate in any kind of commercial activities or sales without our previous written consent;
- Upload, post or distribute offensive contents, including pornography, violence, racism, discrimination or harassment against any group or individual;
- Try to obtain personal information from any User;
- Transmit “spam”, “junk mail”, “malicious contents”, “chain letters” or “unsolicited mass mailing”;
- Publish and promote false or misleading information;
- Promote any kind illegal activities;
Privacy
You agree to the terms of the Boat me up Privacy Policy, as it may be updated from time to time, a copy of which is posted on the Site.
Links to Other Sites
Boat me up may provide you links to other Sites not operated or maintained by Boat me up, but by doing this we are not endorsing those third party websites or their content.
Boat me up assumes no responsibility for content of sites that are managed by third parties.
Modifications to the Service and Prices
Boat me up may discontinue Boat me up services, whenever Boat me up detects the necessity to change it.
Prices of Boat me up are subject to change, by posting the changes to Boat me up Site (www.boatmeup.com).
Boat me up shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of Boat me up services.
Dispute Resolution
This Agreement shall be interpreted and governed by the laws of Portugal. All disputes related to this Agreement shall be resolved exclusively in Portuguese Courts, in Lisbon.
Boat me up reserves the right to start and prosecute legal actions or proceedings before any non-Portuguese court of competent jurisdiction to obtain injunctive or other relief.
Other Miscellaneous Terms
If any clause of this Agreement is found unenforceable, wherever possible this will not affect any other clause or the rest of the agreement that will remain valid.
This Agreement constitutes the entire agreement between you and Boat me up regarding the use of Boat me up services.
